US Addendum & State Privacy Notice

Part A applies to customers billed in the United States and to all traffic sent to or from US numbers. Part B is our notice to residents of California and other US states with consumer privacy laws. Both add to our Terms of Service, Privacy Policy and Acceptable Use Policy; where they conflict, this page applies.

Part A — US Service Terms

1. Contracting entity and law

Customers billed in the United States contract with Voxvalley Technologies Inc., Gurnee, Illinois. The agreement is governed by the laws of the State of Illinois and applicable US federal law.

2. Arbitration and class-action waiver

Except for claims that qualify for small-claims court, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Commercial Arbitration Rules, seated in Chicago, Illinois. Claims may be brought only on an individual basis, not as a plaintiff or class member in any class, collective or representative action. You may opt out of this section by writing to [legal contact email] within 30 days of first accepting the Terms.

3. TCPA and consent

  • You must obtain prior express written consent before sending marketing texts or making marketing calls using an automatic telephone dialing system or an artificial or prerecorded voice, and prior express consent for informational calls of that kind.
  • AI-generated voices, including our AI Voice Agent, are treated as an "artificial voice" under the TCPA. Outbound AI voice calls therefore require the same consent.
  • Honour revocation of consent made by any reasonable means, including replies such as "stop", "quit" or "cancel", promptly and within the time the FCC requires.
  • Do not call or text numbers on the National Do Not Call Registry or your internal do-not-call list for marketing without the required consent, and do not send marketing outside 8 a.m. to 9 p.m. in the recipient's local time.
  • Comply with state telemarketing and texting laws, which can be stricter than federal law, including the Florida and Oklahoma telephone solicitation acts.

4. 10DLC, toll-free and short codes

Application-to-person SMS on US local numbers requires 10DLC brand and campaign registration; toll-free numbers require toll-free verification; short codes require carrier approval. You must follow CTIA Messaging Principles and Best Practices and carrier content rules, including restrictions on sex, hate, alcohol, firearms and tobacco content. Carrier registration fees and per-message carrier surcharges are passed through.

5. Caller ID and robocall mitigation

You may display only caller IDs you are authorised to use. Spoofing with intent to defraud or cause harm is prohibited under the Truth in Caller ID Act. We sign eligible calls under STIR/SHAKEN, maintain a robocall mitigation plan, and cooperate with industry traceback requests; you must respond to traceback requests about your traffic within 24 hours.

6. Call recording

Some states, including California, Florida, Illinois, Maryland, Massachusetts, Pennsylvania and Washington, require the consent of every party to record a call. You must play a recording notice at the start of recorded calls, including calls handled by an AI Voice Agent, and obtain consent where required.

7. Emergency calls

8. Taxes and regulatory fees

Prices exclude federal, state and local taxes and regulatory recovery fees, including Universal Service Fund contributions on voice services where they apply. These are shown separately on your invoice.

Part B — US State Privacy Notice

This notice applies to residents of California and other US states with comprehensive consumer privacy laws, and supplements our Privacy Policy. It covers personal information we collect as a business. It does not cover End-User Data we process as a service provider for our customers; requests about that data should go to the customer that contacted you.

We collect this information from you, from your use of our website and Services, and from carriers and registries. We use it for the purposes in section 3 of our Privacy Policy and keep it for the periods in section 7. We use sensitive information only to provide and secure your account.

Do Not Sell or Share My Personal Information

We do not sell personal information, and we do not share it for cross-context behavioral advertising. We have not done so in the past 12 months. We do not knowingly sell or share the personal information of anyone under 16. We honour Global Privacy Control browser signals as a request to opt out of sale and sharing. If our practices change, we will update this notice and give you a way to opt out before they do.

Your rights

  • Delete personal information, subject to legal exceptions
  • Opt out of sale, sharing, targeted advertising and profiling with legal or similarly significant effects
  • Limit use of sensitive personal information
  • Not be discriminated against for exercising these rights
  • Appeal our decision on your request, where your state law provides that right

How to make a request

We will verify your identity by matching information you give us against our records, and respond within 45 days, extendable once by 45 days where the law allows. You may use an authorised agent, who must provide your signed permission. To appeal a decision, reply to our response with "Appeal" in the subject line.
